Terms and Conditions of Service

1. Acceptance of the terms

Welcome to Cancun100.com. By accessing, browsing, registering or making any booking through this website, you fully and expressly accept these Terms and Conditions, as well as our Privacy Policy, Cancellation Policy and Cookie Policy.

If you do not agree with any of these conditions, we ask you not to use this site. Continued use of the site implies your acceptance of the terms in force at the time of the transaction.

2. Definitions

• "Cancun100", "we" or "the Agency": XPECTATIVE TRAVEL S.R.L. DE C.V., a commercial company incorporated under the laws of Mexico, operator of the site cancun100.com.
• "Customer", "user" or "you": natural or legal person who accesses the site or contracts any of the services offered.
• "Supplier": third party (tour operator, hotel, carrier, theme park, etc.) that materially provides the service booked through Cancun100.
• "Service": tour, excursion, holiday package, transfer, accommodation or tourist experience offered on the site.
• "Service voucher": digital document you receive by email after confirming your payment, which certifies your booking.

3. Purpose of the service

Cancun100, operated by XPECTATIVE TRAVEL S.R.L. DE C.V. (hereinafter, "the Agency"), is a travel agency registered with the Ministry of Tourism of Mexico (SECTUR) under National Tourism Registry number 042300561BC73, verifiable at rnt-consulta.sectur.gob.mx.

We act as intermediaries between the Customer and the Suppliers of tours, excursions, hotels, transport and tourist services in Cancun, Riviera Maya, Playa del Carmen, Tulum and related destinations.

The services offered are described on the corresponding product pages, with detailed information on itineraries, prices, policies and applicable restrictions.

4. Booking process

To book a service, the Customer must complete the corresponding form or contact us on WhatsApp and make the payment through the secure methods available.

Once payment is confirmed, you will receive your service voucher by email with all the details: date, time, meeting point, particular conditions and the Supplier's contact details.

5. Prices and payments

• Prices are expressed in Mexican Pesos (MXN) and/or US Dollars (USD) and include the taxes in force, unless otherwise indicated.
• We reserve the right to change prices at any time; however, bookings already confirmed will keep the agreed price.
• Payments are processed through secure platforms (Stripe, PayPal, MercadoPago, bank transfer) with SSL encryption. Cancun100 does not store full credit or debit card details.
• Cancun100 is not responsible for bank fees, currency conversions, charges for unfounded chargebacks or errors outside our systems.
• Every transaction generates a tax invoice in the name of XPECTATIVE TRAVEL S.R.L. DE C.V. (RFC: XTR2306232CA), available on request at info@cancun100.com.

6. Cancellation policy

The conditions for cancellation, modification, refund and "no show" are governed by our Cancellation Policy, which forms an integral part of these Terms and Conditions.

We recommend that you review that document before confirming any booking.

7. Customer obligations

By contracting our services, the Customer undertakes to:

• Be at the place and time indicated on the service voucher. The maximum tolerance is 15 minutes; after that period it will be considered a "No Show" with no right to a refund, except in duly proven cases of force majeure.
• Check in advance that they meet the physical, medical, age, weight and other specific restrictions of the contracted service. Cancun100 is not responsible for services not enjoyed due to non-compliance with these requirements.
• Follow the instructions of the guide and the Supplier's staff to guarantee their safety and that of the group.
• Carry valid official identification and, in the case of foreign tourists, passport and/or FMM (Multiple Migratory Form).
• Treat the staff, other customers and the facilities, archaeological sites and natural environments visited with respect.
• Provide truthful information when booking (full name as on ID, number of people, real ages, special conditions).

8. About the suppliers

Cancun100 selects its Suppliers based on criteria of quality, safety, current certifications and reputation. However, the material provision of the service rests directly with each Supplier.

Suppliers are independent entities with their own policies, certifications, insurance and staff. Cancun100 is not the employer, partner or legal representative of the Supplier.

Any claim arising from the quality, execution or result of the service must first be channelled through Cancun100, which will act as mediator between the Customer and the Supplier to seek the best possible solution.

9. Disclaimer of liability

In its capacity as intermediary, Cancun100 is not responsible for:

• Losses, theft, accidents, injuries, illnesses or damage suffered by the Customer during the provision of the service, except for demonstrable gross negligence of the Agency.
• Delays, cancellations or changes arising from weather, sea conditions, government restrictions, strikes, demonstrations, pandemics, natural disasters or other causes of force majeure.
• Loss of or damage to the Customer's personal belongings, which are their sole responsibility.
• Insufficient or expired migratory documentation of the Customer at the time of travel.
• Indirect or consequential damages, loss of profit or non-pecuniary losses.

The maximum liability of Cancun100, under any circumstances, is limited to the amount actually paid by the Customer for the specific service that is the subject of the claim.

10. Force majeure

Neither party shall be liable for breach of or delay in its obligations when such breach is the direct consequence of an act of God or force majeure, understood as unforeseeable or unavoidable events beyond the reasonable control of the parties, including but not limited to: hurricanes, tropical storms, earthquakes, floods, pandemics, epidemics, health restrictions, airport closures, decisions of government authorities, airline cancellations, armed conflicts, acts of terrorism, civil unrest or strikes.

In these cases, Cancun100 will offer the Customer reasonable alternatives such as rescheduling the date, changing to an equivalent service or a future credit, depending on the circumstances and availability.

11. Protection of personal data

The processing of the Customer's personal data is governed by the Federal Law on the Protection of Personal Data Held by Private Parties (LFPDPPP) and its secondary provisions, as well as by our Privacy Policy, which forms an integral part of these Terms and Conditions.

12. Intellectual property

All content published on Cancun100.com (texts, photographs, videos, logos, graphics, icons, design, source code, database and any other element) is the exclusive property of XPECTATIVE TRAVEL S.R.L. DE C.V. or its respective licensors, and is protected by the Federal Copyright Law of Mexico and the applicable international treaties.

Its total or partial reproduction, modification, distribution, transmission, public display or commercial exploitation without the prior written authorisation of the Agency is strictly prohibited.

The trademarks "Cancun100", "Cancún100" and their graphic variants are trademarks registered or in the process of registration with the Mexican Institute of Industrial Property (IMPI).

13. Prohibited conduct

The Customer undertakes not to use the site for unlawful purposes or purposes that harm the interests of the Agency or third parties. In particular, it is prohibited to:

• Impersonate another person or provide false information when booking.
• Make fraudulent bookings or bookings with unauthorised cards.
• Attempt to access restricted areas, databases or other people's accounts without authorisation.
• Distribute viruses, malware, malicious code or any tool designed to damage the site.
• Carry out scraping, mass copying or automated collection of the site's content.
• Publish false reviews, slander or misleading information about Cancun100 or its Suppliers.

Failure to comply with any of these rules may result in the immediate suspension of the service, without refund, and in the corresponding legal action.

14. Changes

Cancun100 reserves the right to modify these Terms and Conditions at any time. The most recent version will always be available on this page and will take effect from the moment of its publication.

Bookings already confirmed will be governed by the terms in force at the time of confirmation, unless the changes benefit the Customer or the applicable legislation so requires.

We recommend that you review this page periodically to stay informed of any changes.

15. Jurisdiction and applicable law

These Terms and Conditions are governed by and interpreted in accordance with the laws of the United Mexican States.

For the resolution of any dispute arising from their interpretation or performance, the parties expressly submit to the jurisdiction of the competent courts of the city of Cancun, Quintana Roo, Mexico, waiving any other jurisdiction that may correspond to them by reason of their present or future domicile.
