Terms and Conditions of service
1. Acceptance of terms
Welcome to Cancun100.com. By accessing, browsing, registering or making any reservation through this website, you fully and expressly accept these Terms and Conditions, together with our Privacy Policy, Cancellation Policy and Cookie Policy.
If you do not agree with any of these conditions, please do not use this site. Continued use implies acceptance of the terms in force at the time of the transaction.
2. Definitions
- "Cancun100", "we" or "the Agency": XPECTATIVE TRAVEL SRL DE CV, a commercial company organized under the laws of Mexico, operator of cancun100.com.
- "Customer", "user" or "you": the natural or legal person accessing the site or contracting any of the offered services.
- "Supplier": third party (tour operator, hotel, transportation provider, theme park, etc.) who materially provides the service booked through Cancun100.
- "Service": tour, excursion, vacation package, transfer, accommodation or tourist experience offered on the site.
- "Service voucher": digital document received by email after payment confirmation that proves your reservation.
3. Service description
Cancun100, operated by XPECTATIVE TRAVEL SRL DE CV (hereinafter, "the Agency"), is a travel agency officially registered with the Mexican Ministry of Tourism (SECTUR) under National Tourism Registry number 042300561bc73, verifiable at rnt-consulta.sectur.gob.mx.
We act as intermediaries between the Customer and the Suppliers of tours, excursions, hotels, transportation and tourist services in Cancun, Riviera Maya, Playa del Carmen, Tulum and related destinations.
Each service is described on its corresponding product page with detailed information about itineraries, prices, policies and applicable restrictions.
4. Booking process
To book a service, the Customer must complete the corresponding form or contact us via WhatsApp and complete the payment through the secure methods available.
Once payment is confirmed, you will receive your service voucher by email, including all details: date, time, meeting point, particular conditions and Supplier contact information.
5. Prices and payments
- Prices are quoted in Mexican Pesos (MXN) and/or US Dollars (USD) and include applicable taxes unless otherwise specified.
- We reserve the right to modify prices at any time; however, already confirmed reservations will respect the agreed price.
- Payments are processed through secure platforms (Stripe, PayPal, MercadoPago, bank transfer) with SSL encryption. Cancun100 does not store complete credit or debit card data.
- Cancun100 is not responsible for bank fees, currency conversions, improper chargebacks or errors outside our systems.
- Every transaction generates a tax invoice issued by XPECTATIVE TRAVEL SRL DE CV (Mexican Tax ID: XTR2306232CA), available upon request at info@cancun100.com.
6. Cancellation policy
Cancellation, modification, refund and "no show" conditions are governed by our Cancellation Policy, which is an integral part of these Terms and Conditions.
We strongly recommend reviewing that document before confirming any reservation.
7. Customer obligations
By contracting our services, the Customer agrees to:
- Arrive at the location and time indicated on the service voucher. Maximum tolerance is 15 minutes; after that the booking will be considered "No Show" with no right to refund, except for duly accredited force majeure causes.
- Verify in advance that they meet the physical, medical, age, weight and other specific restrictions of the contracted service. Cancun100 is not responsible for unused services due to non-compliance with these requirements.
- Follow the instructions of the guide and the Supplier's staff to ensure their safety and that of the group.
- Carry valid official identification and, in the case of foreign tourists, a passport and/or FMM (Mexican Tourist Form).
- Treat staff, other customers and the visited facilities, archaeological sites and natural environments with respect.
- Provide truthful information when booking (full name as per ID, number of people, real ages, special conditions).
8. About suppliers
Cancun100 selects its Suppliers based on quality, safety, current certifications and reputation. However, the material provision of the service falls directly on each Supplier.
Suppliers are independent entities with their own policies, certifications, insurance and personnel. Cancun100 is not the employer, partner or legal representative of any Supplier.
Any complaint arising from the quality, execution or outcome of the service must first be channeled through Cancun100, who will act as mediator between Customer and Supplier to seek the best possible resolution.
9. Limitation of liability
As an intermediary, Cancun100 is not responsible for:
- Losses, theft, accidents, injuries, illnesses or damages suffered by the Customer during the provision of the service, except for demonstrable gross negligence by the Agency.
- Delays, cancellations or changes due to weather, sea conditions, government restrictions, strikes, demonstrations, pandemics, natural disasters or other force majeure events.
- Loss or damage of the Customer's personal items, which are their sole responsibility.
- Insufficient or expired immigration documentation at the time of travel.
- Indirect, consequential, lost profits or non-pecuniary damages.
Cancun100's maximum liability, in any circumstance, is limited to the amount actually paid by the Customer for the specific service subject to the claim.
10. Force majeure
Neither party shall be liable for breach or delay in their obligations when such breach is the direct consequence of an act of God or force majeure, understood as unforeseeable or unavoidable events beyond the reasonable control of the parties, including but not limited to: hurricanes, tropical storms, earthquakes, floods, pandemics, epidemics, health restrictions, airport closures, government decisions, airline cancellations, armed conflicts, acts of terrorism, civil unrest or strikes.
In these cases, Cancun100 will offer the Customer reasonable alternatives such as date rescheduling, equivalent service exchange or future credit, depending on circumstances and availability.
11. Personal data protection
The processing of the Customer's personal data is governed by Mexico's Federal Law for the Protection of Personal Data Held by Private Parties (LFPDPPP) and its secondary provisions, as well as our Privacy Policy, which is an integral part of these Terms and Conditions.
For visitors from the European Union, we acknowledge applicable provisions of the General Data Protection Regulation (GDPR) where relevant. For California residents, applicable provisions of the CCPA are observed. Refer to our Privacy Policy for full details.

12. Intellectual property
All content published on Cancun100.com —text, photographs, videos, logos, graphics, icons, design, source code, database and any other element— is the exclusive property of XPECTATIVE TRAVEL SRL DE CV or its respective licensors, and is protected by Mexico's Federal Copyright Law and applicable international treaties.
Total or partial reproduction, modification, distribution, transmission, public display or commercial exploitation without prior written authorization from the Agency is strictly prohibited.
The trademarks "Cancun100", "Cancún100" and their graphic variants are registered trademarks or trademarks pending registration before the Mexican Institute of Industrial Property (IMPI).
13. Prohibited conduct
The Customer agrees not to use the site for unlawful purposes or for purposes that harm the Agency or third parties. In particular, the following is prohibited:
- Impersonating another person or providing false information when booking.
- Making fraudulent reservations or using unauthorized cards.
- Attempting to access restricted areas, databases or other accounts without authorization.
- Distributing viruses, malware, malicious code or any tool designed to harm the site.
- Performing scraping, mass copying or automated content harvesting from the site.
- Publishing false reviews, slander or misleading information about Cancun100 or its Suppliers.
Breach of any of these conducts may result in immediate suspension of service without refund and in any legal action that may apply.
14. Changes to terms
Cancun100 reserves the right to modify these Terms and Conditions at any time. The most recent version will always be available on this page and will take effect upon publication.
For already confirmed reservations, the terms in force at the time of confirmation will apply, unless modifications benefit the Customer or are required by applicable law.
We recommend reviewing this page periodically to stay informed of any changes.
15. Jurisdiction and governing law
These Terms and Conditions are governed by and interpreted in accordance with the laws of the United Mexican States.
For the resolution of any controversy arising from their interpretation or fulfillment, the parties expressly submit to the jurisdiction of the competent courts of the city of Cancun, Quintana Roo, Mexico, waiving any other jurisdiction that may correspond to them by reason of their present or future domicile.
